leave of absence

When you return from a leave of absence 12 weeks or less, I know that you are entitled
to the same job when you return. What about the hours? Can they change your shift
from days to nights when you come back? Thanks.

What is your availability? As long as they stay within your availability they can schedule you any shift.

Well, when I left, I was four days, one night one week, then three
days, two nights the next and so forth. Now they say that there
are no daytime hours available for me at all, that I have to work
all nights. I have open availability, but for 13 years I had day
hours. Right before I left is when I started that new schedule.

I should also mention that out of all the people on the
IMS team, I am the only one working all nights. Originally,
before I left, all of us were supposed to have equal time
working some days and some nights. They all got out of it
somehow and are all back on days and now that I'm back,
I'm the only one doing nights. Sounds like it's payback to
me.?

they had a lot of changes to the ims team in the last 12 weeks....

maybe talk to your store manager about it and he/she can explain the changes to you

It depends, was your leave of absence medical or not? I could be wrong. But I believe if they at least keep you in the same job code they may be able to change your schedule around., to allow someone to come in to do your job while your gone. I work with an associate who was out on a leave of absence and his days and hour were switch so someone else could take his hours and work his shift. His hour and days were never put back the way they were.

You may want to talk with personnel about it, or a member of management. If nothing else go to your store manager. If you still believe your not being help then go to your market manager. But most likely the store manager knows most of the procedures.

P.S since i don't know why you took off i can give you any better advice then this. If it is medical, then you probably can make an argument about your hours being change if it is personal then probably not!!!

Leave of Absence
Sometimes you need to take time away from work to deal with life’s unexpected events. There are three types of Leaves of Absence available to help you. These cover medical events, some personal situations and the need to service your country in the military.

Medical Leave

An approved Medical Leave provides you with time away from work so that you can receive medical treatment and/or recover from medical treatment, injury or disability. This includes disabilities related to pregnancy, childbirth and other eligible illnesses or injuries.

Personal Leave

An approved Personal Leave provides you with time away from work so that you can deal with personal situations such as a family crisis, continuing your education or caring for an ill or injured relative.

Military Leave

If you volunteer for or are required to perform active, full-time U.S. Military duty or to fulfill National Guard or Reserve obligations, you will be granted a Military Leave. A copy of your military orders must accompany your request for Military Leave.

P.S i was told one by my manager that, Wal-Mart is not required to give you back your old position and hours unless your away on a military leave.
